Addressing a crowded press conference in Lahore on February 14, Dr Muhammad Tahir-ul-Qadri has said that he is professor of law and holds the court in the highest esteem. He made it clear that he would not launch any movement against the judicial observation in regard to his petition. He said that his movement was for the purpose of nation building, which would continue unabated with the same zeal and zest. On the third day of hearing, the Supreme Court of Pakistan dismissed Dr Muhammad Tahir-ul-Qadr’s petition in which he had prayed to the Court to order recomposition of the Election Commission in accordance with the relevant provisions of the Constitution. A three-member bench of the Supreme Court headed by Chief Justice Iftikhar Muhammad Chaudhry took up petition of Dr Tahir-ul-Qadri for preliminary hearing in which he prayed to the Court to order reconstitution of the Election Commission of Pakistan as the latter was not formed according to Articles 213 and 218 of the Constitution of Pakistan. Dr Muhammad Tahir-ul-Qadri argued the case himself in the apex court. In reply to a question of the honourable Chief Justice whether a dual national could challenge the constitution of the Election Commission, Dr Qadri said that though dual nationals could not become part of Parliament but had the constitutional right to challenge the composition of the Election Commission in their capacity as voters. A three-member bench of the Supreme Court of Pakistan headed by Chief Justice Iftikhar Muhammad Chaudhry will take up the petition of Dr Tahir-ul-Qadri for initial hearing on February 11 (Monday). Other members of the bench are Justice Gulzar Ahmad and Justice Sheikh Azmat Saeed. In his petition, Dr Qadri has challenged the constitution of the Election Commission of Pakistan on the basis that the Commission was not constituted as per Articles 213 and 218 of the Constitution. He has prayed to the apex court to declare all appointments as void ab initio.
